When is it sold?
The answer is, as always, depends on the state and the company that is selling it.
In most states, a lobster sale is considered legal only if it is bought with a valid permit and sold on a private or public sale.
But in other states, the sale of a lobster is considered a commercial activity, meaning that you can legally sell the lobster at any place where it is not on the food chain.
